In your divorce you may notice the term Majauskas or Majauskas Formula relating to the division of your pension of retirement assets. Majauskas is the name of a New York State Court of Appeals case – the highest court in New York state – from 1984, which established the rights of a former spouse to the other spouse’s pension or retirement assets. How that’s calculated, generally, is that it looks at the time from the date of the marriage until the date that the divorce began. We call it the commencement of the action for divorce. It’s the benefits earned during that time that are subject to being split. We call that the marital share.
