When a New York Firing May Be Unlawful
New York generally follows at-will employment for private-sector workers, meaning an employer may terminate employment for many reasons or without stating a reason. A firing may be unlawful, however, when it is based on a characteristic protected by law or retaliates against an employee for protected activity.
Examples may include discrimination based on race, color, religion, sex, national origin, age, disability, sexual orientation, gender identity or expression, military status, marital status, or another legally protected characteristic. Retaliation may also be prohibited when an employee reports discrimination or certain labor-law violations, requests a reasonable accommodation, files a workers’ compensation claim, or engages in other protected conduct.
What Relief May Be Available
The relief available in a wrongful-termination matter depends on the applicable law and the facts of the case. Potential remedies may include back pay, lost wages and benefits, reinstatement, financial compensation, changes to an employer’s policies, or other relief ordered by a court or government agency.
Filing deadlines and procedures vary. Employees should consider preserving termination notices, performance reviews, employment policies, relevant communications, and a timeline of events. The New York Attorney General’s termination guidance and the New York State Division of Human Rights employment discrimination guide provide additional information.
